OFFICIAL CONTEST RULES



NO PURCHASE IS NECESSARY TO ENTER OR WIN. THIS CONTEST IS OPEN TO LEGAL RESIDENTS OF THE UNITED STATES CURRENTLY RESIDING IN THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA (EXCLUDING PUERTO RICO) WHO ARE THIRTEEN (13) YEARS AND OLDER AS OF MARCH 3, 2009 AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO U.S. LAW. DO NOT ENTER THIS CONTEST IF YOU ARE NOT LOCATED IN THE 50 UNITED STATES OR DISTRICT OF COLUMBIA.



HOW TO ENTER: Americans nationwide can enter for a chance to win a Dreyer's Slow Churned Neighborhood Salute ice cream block party by nominating their neighborhood via mail (see details in Section 3) or via Internet by visiting www.dreyers.com between March 3, 2009 at 12:01 AM (ET) through May 29, 2009 at 11:59 PM (ET) and following the on-screen instructions to reach the contest entry page. On the registration page and in the spaces provided, entrants must supply his/her name, street address, evening phone number, date of birth, email address and entry-related assets: written essay or video submission.   1. If you wish to submit your entry as a written essay:
    1. Submit a short paragraph (using no more than 350 words) explaining why your neighborhood deserves a Slow Churned Neighborhood Salute.
    2. Incomplete entries will be disqualified and discarded upon receipt without further consideration and without notification of entrants.
    3. All mailed entries must be received by 11:59 p.m. ET on May 29, 2009 in order to be eligible. Completed mail-in entries should be sent to:

      PLEASE NOTE: Video entries will not be accepted via regular mail. Only written essays will be accepted via regular mail. Damaged, mutilated or otherwise illegible entries will be disqualified and discarded upon receipt without further consideration and without notification of entrants.

  2. If you wish to submit a video entry:
    1. Using your own video recording device, record a video (herein after referred to as "Video") illustrating why your neighborhood deserves a Slow Churned Neighborhood Salute.
    2. Video Requirements: Video submission must not exceed one [1] minute in length. The maximum files size for any Video file uploaded is 100 MB. Videos must be submitted in one of the following file formats: .mov; .mpg, .mpeg, or .avi.
    3. Video entries must be submitted via Internet by visiting www.dreyers.com. Videos submitted via regular mail will not be accepted. All video entries must be received by 11:59 p.m. E.T., May 29, 2009 in order to be eligible.
    4. By submitting a Video, entrant agrees that Dreyer's Grand Ice Cream, Inc. ("Sponsor") shall own the Video submitted and that it and its designees may exploit, edit, modify, and distribute the photo and all elements of the Video, including, without limitation, the names and likenesses of any persons or locations embodied therein, in any and all media now known or not currently known, throughout the world in perpetuity without compensation, permission or notification to entrant or any third party. By submitting a Video, entrant warrants that the Video is an original creation and that entrant is the sole copyright owner. Sponsor may highlight the entered Video on their web site, internal publications, or any media outlet.
    5. Each Video cannot:
      1. Contain material that is violent, pornographic or otherwise obscene, illegal, or racially or morally offensive, as determined by Sponsor;
      2. Contain defamatory statements (including but not limited to words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic group);
      3. Include threats to any person, place, business, group or world peace;
      4. Invade the privacy or other rights of any person, firm or entity;
      5. Contain or refer to any food or beverage product by brand name other than Slow Churned light ice cream;
      6. Contain or refer to any third party copyrights, trademarks, logos, or trade dress (with the exclusion of Slow Churned Brand or any other asset provided by the Sponsor for use by in connection with the Contest), or
      7. Violate any law, rule, or regulation that may apply to the Promotion, including but not limited to those concerning copyright, plagiarism, trademark, defamation and invasion of privacy.
      8. Use of any elements, including without limitation music, audio, speech/voiceovers, video, stills, visuals, or other materials that are not original, in the public domain, or downloaded from the Web Site may result in disqualification of Video, at Sponsor's sole discretion.
    6. General Conditions on Videos: Videos that do not comply with the Official Rules, or that otherwise contain prohibited, or inappropriate content as determined by the Sponsor in its sole discretion, may be deleted, and/or disqualified, and will not be published or considered for a prize. Sponsor makes the final determination as to which Videos are eligible to take part in this Contest and be considered for a prize.
    7. If a Video features any person other than the Entrant, the Entrant should be able to provide on request all appropriate clearances, permissions and releases for the Submission, including releases from all persons appearing in the video, location releases for all recognizable locations, and releases from all creative consultants or others who assisted in the creation of the video (in the event a Entrant cannot provide all required releases, Sponsor reserves the right, in Sponsor's sole discretion, to disqualify the applicable Submission, or seek to secure the releases and clearances for Sponsor's benefit, or allow the applicable Submission to remain in Contest).
    8. All Video Contest Submissions must be uploaded during the Contest Period (March 3, 2009 12:01 a.m. ET through May 29, 2009 11:59 p.m. ET.) No Submissions will be accepted after the Contest Period has ended, nor will any Submissions be returned to the Entrants.
  3. JUDGING: Judging will be completed by a panel of experts. The Panel will review all eligible entries submitted online and via mail and will select the top One Thousand Five Hundred (1,500) entries to receive the Slow Churned Neighborhood Salute grand prize package listed in Section 5 (Grand Prize Package).

    Judging will be based on the following criteria:

    Originality/Creativity 50%
    Enthusiasm 25%
    What makes your neighborhood special 25%

    All decisions of the judges shall be final and shall not be subject to any review.
  4. WINNERS AND WINNER NOTIFICATION: One Thousand Five Hundred (1,500) Grand Prize winners each will receive the grand-prize package listed below and will be notified on or about June 16, 2009 to the email or mailing address provided with the entry. Limit one prize per household or address.
  5. GRAND PRIZE PACKAGE: Each winning entrant will be required to sign and have notarized an affidavit/prize acceptance/release of liability form to receive a grand prize package consisting of the following:
    - Door-step Delivery of ten (10) cartons of Dreyer's Slow Churned® light ice cream and thirty six (36) Dreyer's Slow Churned® light ice cream snack size cups ($250.00 ARV)
    - One (1) "Party In A Box" (including, but not limited to: apron, napkins, ice cream scoops, spoons, name tags, disposable camera) ($175.00 ARV)
    - Total Retail Value for each prizewinner is $425.00 [Total approximate retail value for all grand prize winners is $637,500].
    Return of any prize or notification as undeliverable will result in disqualification and an alternate winner may be selected.
  6. PRIZE RESTRICTIONS: Prizes are non-transferable. No substitution or cash equivalent of the prizes will be granted except at Sponsor's sole discretion. All taxes not specified are the responsibility of the winners. Sponsor reserves the right to substitute prize of equal or greater value. Limit one prize per household or address.
  7. GENERAL RULES: Open only to legal residents of the United States ages thirteen (13) years and older as of March 3, 2009. Employees of Dreyer's Grand Ice Cream, Inc., directors, officers, affiliates, subsidiaries, advertising and promotion agencies and their immediate family members and/or those living in the same household are not eligible. Void where prohibited by law. All federal, state, and local laws and regulations apply. By submitting an entry, you acknowledge and agree that your entry is your original work and understand that it becomes the sole and exclusive property of Sponsor and acceptance of a prize constitutes permission to Sponsor and its agencies to use the winning Dreyer's Slow Churned Neighborhood Salute winner's name and likeness for purposes of advertising, promotion and trade without further compensation unless prohibited by law. However, the addresses, telephone numbers, and email addresses of entrants will not be sold or otherwise provided to any third parties. By participating in this contest, entrants expressly acknowledge compliance with these Official Rules, and waive all right to, and hold harmless, Sponsor and its advertising and promotions agencies from any loss, damage or expense arising out of or in connection with participation in this contest or the acceptance, use or misuse of any prize. Return of any prize notification as undeliverable will result in disqualification and an alternate winner may be selected. By participating in this promotion, entrants agree to be bound by the Official Rules. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the promotion or in the announcement of the prizes.
  8. REPRESENTATIONS AND WARRANTIES: By participating in the Contest, Entrants affirm, represent, and/or warrant that: (i) Entrant owns or has the necessary licenses, rights, consents, and written permissions to use and authorize Sponsor to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all Submissions to enable inclusion and use of the Submissions in the manner contemplated by the Sponsor and these Official Rules; (ii) Entrant has the written consent, release, and/or permission of each and every identifiable individual person in the Submission to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of the Submission in the manner contemplated by the Sponsor and these Official Rules and can make written copies of such permissions available to the Sponsor upon request, and (iii) Entrant's Submission is not copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless Entrant is the owner of such rights or otherwise has permission from the rightful owner(s) to participate in the Promotion and to make such Submission for the purposes intended by Sponsor. Entrant further agrees that he/she will not (i) publish falsehoods or misrepresentations that could damage Sponsor or any third party; (ii) submit material that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate; (iii) post advertisements or solicitations of business: (iv) impersonate another person.
  9. OTHER CONDITIONS: Sponsor assumes no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors, failures of any kinds, delayed computer transmissions or network connections that are human or technical in nature. Sponsor reserves the right in its sole discretion to cancel or suspend this contest, in its entirety or in part should virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond Sponsor's control corrupt the administration, security, fairness, integrity or proper play of the contest. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the contest by any technical or human errors which may occur in the processing of the entries in the contest. Sponsor reserves the right to withdraw the transmission of this contest at any time and award the Prize from among eligible entries received prior to the date of the withdrawal. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the game or web-site or to be acting in violation of the Official Rules.
  10. LIST OF WINNERS: A list of winning entrants will be available online at www.dreyers.com by July 31, 2009 or send a self-addressed-stamped envelope to "SLOW CHURNED NEIGHBORHOOD SALUTE" 5929 College Avenue, Oakland, CA 94618. Requests must be received by June 30, 2009.
  11. SPONSOR: Dreyer's Grand Ice Cream, Inc., 5929 College Avenue, Oakland, CA 94618. There will be a total of One Thousand Five Hundred (1,500) prizes awarded in this contest.
